Contract Terms & Conditions
These Terms and Conditions constitute an Agreement and are the basis upon which My Dress Limited agrees to supply you (the “Purchaser”) with Goods and/or Dresses. These Terms and Conditions shall not be amended without prior agreement in writing executed by both parties.
Definitions:
“Goods” – All items that can be purchased from our store.
“Dress” – Wedding dress and / or Bridal Dresses or any other Dress.
“My Dress Ltd” – My Dress Limited.
“Order Date” – the date your order is placed with us.
“Arrival Date” – the anticipated date your goods arrive in the store – for clarity this is an estimated arrival date.
Payment:
The description and price of Goods and Dresses are provided for in the Contract appended hereto.
A 50% deposit shall be paid on the Order Date. This sum is non-refundable.
My Dress Ltd are unable to provide a precise Arrival Date for Dresses or Goods but estimate that it may take between 4 to 8 months from the Order Date. My Dress Ltd accepts no responsibility whatsoever if Dresses or Goods are not received by the Arrival Date. My Dress Ltd will endeavour to keep the Purchaser appraised of all anticipated delays and will take all reasonable steps to prevent such delays. The Purchaser shall discharge all reasonable fees associated with delivery where applicable.
Upon notification to you by My Dress Ltd of the Arrival Date, one month will be allowed for you to attend at our store and collect your Dress. The final balance must be paid on the collection of your Dress.
If full payment is not received within one month of the Arrival Date being notified to you, the Goods and/or Dress(es) will not be provided to the Purchaser and all efforts will be made to resell the Goods and / or Dress(es). Failing this, My Dress Ltd reserves the right to pursue the Purchaser for all expenses incurred for breach of contract as a result of their failure to complete the purchase. All goods remain the property of My Dress Ltd until such a time as payment is made in full.
On receipt of final payment, all Goods and / or Dresses shall be collected from the premises of My Dress Ltd which is located at 37/38 Main Street, Carrick-on-Sur, County Tipperary.
My Dress Ltd does not carry out alterations to Dresses and / or Goods. While staff in My Dress Ltd may recommend an alterations shop to carry out such alterations, My Dress Ltd shall not be responsible for any loss or damage which results following such a recommendation.
Dresses:
The Purchaser acknowledges that as far as possible the manufacturer and designer will make every effort to match samples. There may however be slight variations in colour and texture of fabric especially in the case of silk, which is a natural fabric.
The Purchaser acknowledges and accepts that fabric, the positioning of embroidery or beading and colour shades/trims may differ slightly from original samples seen in the My Dress Ltd showroom and ordered at the Purchaser’s discretion.
The Purchaser is on notice that measurements not taken by My Dress Ltd staff members may not be correct and My Dress Ltd shall not be responsible for any issues arising as a result of inaccurate measurements.
While My Dress Ltd provides guidance in terms of design, size colour and measurements, My Dress Ltd accepts no responsibility for any such guidance.
My Dress Ltd accept no responsibility for weight/inch loss or weight/inch increase including pregnancy after taking a Purchasers order. The Purchaser will be responsible for any costs incurred if a new Dress(es) or Goods or extra fabric have to be purchased.
Dresses are ordered in 10, 12, 14, 16 etc., the nearest to your measurements taken. They are not made to measure so alterations are always required.
All Goods and accessories must be paid for on the Order Date and are non-refundable.
Liability:
The Purchaser shall be fully liable for the full cost of Dress(es) and / or Goods with effect from the Order Date.
My Dress Ltd accept no liability whatsoever for any damage to Dress(es) or Goods arising from wear and tear, wilful damage, accident, negligence by the Purchaser or any third party or use otherwise than as recommended by My Dress Ltd or failure to follow instructions of My Dress Ltd or any alteration or repair.
My Dress Ltd shall not be deemed to be in breach of these Terms and Conditions as a result of acts beyond its reasonable control including without limitation acts of God, war, riot, civil commotion or terrorist attack, malicious damage, compliance with any law or governmental order, accident, fire, flood, storm or global or local pandemic.
Sale Goods:
No refunds under any circumstance or exchanges can be given on any sale goods. The price of sale goods does not include the cost of cleaning or alterations required. You purchase what you see.
Other:
For reasons of hygiene, no refunds or exchanges can be given on any veils, shoes, hosiery, millinery, headpieces.
This Agreement and any dispute or claim arising out of or in connection with it or its subject matter shall be governed by and construed in accordance with Irish Law.
